Ness Botanic Gardens Photography Workshop Terms and Conditions

Please review our terms and conditions carefully prior to booking. By booking a workshop, you agree to abide and be bound by these terms and conditions. If you have any questions or concerns about this agreement, please contact us.

  1. For the avoidance of doubt, references herein to "us" "we" and "our" shall also refer to Stuart Robinson Photography Ltd.

  2. Participants must be over the age of 16 to participate.

  3. Participants must be able to walk/move around reasonable distances, including up slopes and carry their own photographic equipment with them.

  4. In order to get the most out of the workshop, you please arrive on time. If you are unable to attend you must notify us beforehand. Latecomers to group workshops are admitted only according to our discretion. You are not entitled to a refund if, because of your lateness, you miss all or a portion of the workshop.

  5. Please get in touch with any health concerns in advance of booking your place on the workshop. Every effort will be made to accommodate participants with additional support or mobility needs. Please inform us of any additional requirements in advance of booking a place on the workshop. Registered carers may accompany the participant to the workshop free of charge.

  6. It is vital that if you have symptoms associated with coronavirus including a new continuous cough and a high temperature, that you self-isolate and do not attend the tutorial.  Please contact Stuart Robinson Photography for advice on re-booking.

  7. PPE will be provided and face coverings must be worn by both the tutor and participant at all times.

  8. Participants will stay two metres apart at all times.  Where equipment is to be demonstrated, hand sanitiser will be provided along with anti-bacterial wipes (for equipment).

  9. Any activities within the Visitor centre and/or Conference Room will be conducted according to current Government social distancing regulations.  Participants will remain two meters apart, including when viewing a shared computer screen.  Hand sanitiser will be provided along with anti-bacterial wipes (for equipment).

  10. Participants must ensure they bring along their own camera and equipment on the day as Stuart Robinson Photography is unable to provide any equipment on loan.

  11. Photography workshops are non-refundable and non-transferable unless due to exceptional circumstances (illness/injury, pregnancy or bereavement). This will be at our discretion and proof may be requested. Please contact Stuart Robinson Photography if you are unable to attend.

  12. Stuart Robinson Photography reserves the right to reschedule any of the booked workshop dates. We will give as much notice as possible; however this cannot always be guaranteed. If we cancel your workshop and no other dates are suitable, a full refund will be issued.

  13. Should Ness Botanic Gardens be closed due to unforeseen circumstances (such as a Government lock-down, unsafe conditions or illness), we will give as much notice as possible; however this cannot always be guaranteed. If we cancel your workshop and no other dates are suitable, a full refund will be issued.

  14. The weather should not affect the experience, although the itinerary may be changed if conditions are unsuitable for any aspect of the workshop. In the case of severe weather the workshop may be rescheduled for another date. We will endeavour to provide as much notice as possible but please be aware that cancellations may occur on the day of the experience for reasons beyond our control. If we are unable to rearrange the date with the participant, a full refund will be issued.

  15. Guests of the participant are not permitted to follow the group or individual around the gardens.

  16. Entry to Ness Botanic Gardens is included in the workshop price.

  17. Participants can take breaks when required and the public facilities at Ness Botanic Gardens used whenever needed.  If participants book two consecutive sessions - morning and afternoon - they are free to use the Ness facilities in the capacity of a regular garden visitor.  Participants can bring their own lunch to be consumed either outdoors or in the teaching room if the weather is inclement.  Any waste must be placed in one of the dedicated receptacles or taken home.

  18. No alcohol will be consumed and there will be no smoking (or “vaping”) in any buildings.  If participants wish to smoke (or “vape”) then they must be at least five metres from any building and buts must be disposed of in a suitable bin.

  19. Stuart Robinson Photography will not be responsible for any equipment of any participant. It is the participant’s responsibility to keep their equipment safe, secure and protected from the weather. Stuart Robinson Photography is not responsible for any personal injury or damage to property arising from incidents occurring at the workshop venue.

  20. Our liability shall be limited to the total value of the workshop only. We are not liable for any indirect or consequential loss.

  21. Attendees are not permitted to use images taken at the workshop for commercial purposes, images can only be used as part of a portfolio. Social media usage is allowed but only to showcase your portfolio. Images must not be used to advertise photo shoots, workshops or products or used as stock photos or on any image libraries for sale or other third party use. Images must not be submitted to magazines, exhibitions or competitions without permission.

  22. Participants should only photograph the gardens (landscapes) and wildlife and avoid capturing members of the public. If participants wish to photograph other participants in the workshop they should seek the personal consent of the participant being photographed, this arrangement will be between the individuals and not the responsibility of Stuart Robinson Photography or Ness Botanic Gardens. You acknowledge that we have advised you that none of the participants in the workshop have signed releases allowing commercial use of any images taken at the workshop and that you may be subject to legal liability if you use any images commercially.

  23. We reserve the right to use any photos taken by us during the experience for the experience marketing purposes only. This includes photos with the participants visible in the frame, which will be made clear to you at the time. Should you wish to restrict usage of the photos with you in them, a written notice is required.

  24. In order for Stuart Robinson Photography to deliver and provide the contract we have with you (being the contract for sale of products or services), we need to collect and process certain data about you – for example, your name, address and details to enable payment, and, in some cases, health data to ensure that we can ensure your comfort and safety during the event you have contracted from us. We will only ever process this data in compliance with the Data Protection Act 2018, and the GDPR. You can see more details of the data we collect in our Privacy Policy.
